John D. Horowitz


John represents employers across the country on a wide range of labor, employment and construction law matters. His clients run the gamut, from multi-national corporations to mom-and-pop shops.

For unionized clients, John negotiates and administers their collective bargaining agreements and/or project labor agreements, which includes strike contingency planning. John has handled dozens of labor arbitrations for unionized clients, and litigates representation claims, unfair labor practice charges, and work jurisdiction disputes before the National Labor Relations Board (NLRB).

For construction industry clients, John negotiates and administers their construction contracts, and counsels these clients on unpaid and/or extra work claims, defective work claims, mechanic’s liens, payment and performance bonds, delays, and suspension and termination of work.

John also maintains a thriving litigation practice, built upon his success representing companies in the courtroom and before governmental agencies. He shows the same tenacity, discipline and work-ethic he displayed as an amateur boxer, which has translated into wins for his clients. This is why John is now being retained by other law firms to first-chair their most challenging jury trials.

John regularly appears before state and federal courts, government agencies and arbitrators around the country, representing companies in construction, labor and/or employment disputes, including breach of contract, breach of fiduciary duty, fraud, wrongful termination, discrimination, workplace harassment, whistleblower, wage/hour and prevailing wage claims. As part of his practice, John has successfully litigated cases involving claims for breach of construction contracts, services contracts, joint venture agreements and non-compete agreements.

Finally, a significant portion of John’s practice is devoted to counseling employers on day-to-day labor and employment issues, including EEO, ADA, FMLA, OSHA and FLSA compliance; discipline and discharge decisions; and, handling mass layoffs and reductions in force. John also drafts employment policies, employment contracts, non-compete agreements and separation agreements, as well as operating, services and independent contractor agreements.
